Lindsie Chrisley Files to Suppress Evidence After DUI Arrest

Lindsie Chrisley has filed a motion to suppress all evidence that was seized during her DUI arrest last month, Us Weekly can exclusively reveal.

According to the motion filed by Chrisley’s lawyer on Monday, June 1, and obtained by Us, the Chrisley Knows Best alum, 36, “anticipates that [prosecutors] … will attempt to introduce … evidence of property illegally obtained or seized.”

“All property or evidence seized from [Chrisley] was done so illegally due to a lack of probable cause to seize the items,” the court docs state.

Chrisley’s lawyer listed several legal grounds to suppress, including “no probable cause for a warrantless search” and “no probable cause for issuance of a search warrant.” Her lawyer also claimed that the search warrant “exceeded the scope authorized” and was “illegally executed,” while “excessive force” was allegedly used “in the execution of the search warrant.”

The warrant was also allegedly “executed at an unreasonable time,” and the executing officers “lacked valid consent to search the person or premises searched,” according to the docs.

“There existed no probable cause for an impoundment and inventory search of the property,” the docs concluded.

Chrisley’s legal team requested the opportunity to specify the motion once they obtain discovery prior to trial.

Chrisley was arrested in Georgia on May 23 for DUI less safe, attempting to elude police, improper passing, reckless driving and speeding, Us confirmed at the time. Officers spotted her vehicle “speeding, tailgating and flashing their high beams.” (In Georgia, DUI less safe means that someone may face charges of driving under the influence even if their blood alcohol concentration is below 0.08 percent.)

The Cherokee County Jail confirmed that the podcaster was released after posting bond on May 24. Her bail was set at $1,355 for DUI less safe, $680 for improper passing, $565 for reckless driving and $2,006 for speeding.

According to the police report from the arrest obtained by Us, Chrisley was allegedly traveling at nearly 90 miles per hour and “fled” from a cop. She also allegedly refused to partake in a field sobriety test. The arresting officer noted in the report that Chrisley’s breath allegedly smelled like alcohol and that she was slurring her words.

Chrisley broke her silence on the arrest in a statement to TMZ.

“I got pulled over speeding past a car on a two lane road because they almost hit an animal and I was trying to miss hitting them and whatever the animal was,” the TV personality said, noting that she planned to “fight the charge.”
